A Polícia Civil do Espírito Santo (PCES) por meio do 12º Distrito Policial (DP) da Serra, localizado em Jardim Limoeiro, deflagrou nesta terça-feira (12) a Operação Contumélia. Entre os alvos estava uma auxiliar de escola de 29 anos, que agia com abuso de confiança e foi indiciada pelo crime de peculato após furtar cartões Serra Nutri Ferias da Prefeitura da Serra, em uma escola no bairro Novo Horizonte.
O objetivo da operação foi cumprir dois mandados de busca e apreensão contra duas investigadas: uma auxiliar de escola de 29 anos e uma diarista de 32 anos, ambas acusadas de agir com abuso de confiança. Inicialmente, as investigadas respondem aos crimes em liberdade.

Primeiro alvo da Operação Contumélia
Durante a ação, foram apreendidos 106 cartões do “Serra Nutri Férias“, da Prefeitura Municipal da Serra, destinados a alunos da escola para a compra de alimentos no período de férias, um notebook desviado de uma escola do município, uma máquina de cartão de crédito/débito e um aparelho de celular.
Segundo as investigações, uma auxiliar administrativa de 29 anos, que atuava em uma Escola Municipal da Serra, localizada no bairro Novo Horizonte, apropriou-se indevidamente de cartões “Nutri Férias”, da Prefeitura da Serra. O benefício é destinado a alunos da escola para a compra de alimentos em comércios da região no período de férias, sendo concedido pelo município neste ano, com valores de R$ 150,00 em janeiro e R$ 100,00 em junho.

Cadê o cartão que estava aqui?
A suspeita era responsável na escola pela entrega dos cartões aos pais dos alunos. Diante de uma parcela significativa de pais, aproximadamente 10%, que não retiraram os cartões em nome dos filhos, a suspeita subtraiu indevidamente os cartões da instituição de ensino. A escola conta com mais de mil alunos, e durante o cumprimento de mandados de busca e apreensão em sua residência, localizada no mesmo bairro da escola, foram encontrados 106 cartões.
Por meio da apropriação indevida dos cartões, a indiciada transformava o benefício em dinheiro em espécie. Dona de uma empresa registrada em seu nome, ela tinha uma máquina de cartão, que usava para realizar transações com os cartões, direcionando os créditos para sua própria conta bancária. Segundo a investigada, tais recursos eram destinados à aquisição de materiais de construção, que estavam sendo utilizados em uma reforma na sua residência.
A Polícia Civil estima que a suspeita tenha obtido benefícios financeiros no valor de R$ 15.900,00, em janeiro, e R$ 10.600,00 em junho, totalizando, no mínimo, R$ 26.500,00. Esse montante corresponde aos 106 cartões apreendidos em sua residência, podendo o valor ser superior.
Além dos cartões, na residência foram apreendidos um caderno com anotações dos nomes dos alunos e turmas, constatando os cartões que não foram retirados pelos pais dos alunos. Também foram encontrados um notebook desviado da escola, uma máquina de cartão de crédito/débito e um aparelho de celular.
A investigada, após ser intimada, compareceu à Delegacia Distrital, durante o interrogatório, confessou o crime. Ela será indiciada pelo crime de peculato. Esse delito visa punir o funcionário público que, em virtude do cargo que ocupa, tem a posse de um bem público e o utiliza indevidamente em proveito próprio ou de terceiros. O peculato está tipificado no artigo 312 do Código Penal Brasileiro (CPB) e prevê uma pena de prisão que varia de 2 a 12 anos em caso de condenação.
Operação “Contumélia”
O nome é uma referência ao significado da palavra “Contumélia”, que se traduz como abuso ou afronta. Assim como o comportamento das investigadas, que, ao agirem com abuso de confiança, cometeram os crimes pelos quais estão sendo indiciadas.
