Na última quarta-feira (17), o Tribunal Regional Eleitoral do Espírito Santo, representado pela juíza eleitoral da 26ª Zona Eleitoral de Serra, Dra. Cristina Eller Pimenta Bernardo, aceitou cinco pedidos liminares apresentados pelo partido Republicanos do Diretório Municipal da Serra. O partido denunciou a divulgação de uma pesquisa eleitoral, no âmbito do município, sem o devido registro no Tribunal Superior Eleitoral (TSE).
Conforme noticiado em primeira mão pelo Serra Noticiário no dia 13 deste mês, apoiadores do ex-prefeito da Serra e pré-candidato a prefeito, Audifax Barcelos, foram flagrados compartilhando nas redes sociais dados de uma pesquisa eleitoral que não consta no sistema de pesquisa do site do TSE. A matéria, intitulada “Compartilhar pesquisa eleitoral sem registro ou falsa pode gerar multa de até R$ 106 mil“, alerta para as consequências legais de divulgar informações eleitorais não registradas.

Juíza suspeita da credibilidade da pesquisa
Analisando as decisões, a juíza eleitoral da 026ª Zona Eleitoral de Serra, bem como a reportagem do Serra Noticiário, não encontrou o registro da pesquisa divulgada pelos apoiadores dos pré-candidatos no site do TSE. A juíza também relembrou que “as entidades e empresas que realizam pesquisas de opinião pública relativas às eleições, para conhecimento público, devem fazer o devido registro do trabalho estatístico, com até 5 (cinco) dias de antecedência à divulgação, junto à Justiça Eleitoral.“
Durante a sentença, a juíza afirmou que a pesquisa supostamente sem registro eleitoral divulgada pelos apoiadores pode ser fraudulenta, dizendo: “Assim, parece-me que a pesquisa divulgada não possui o devido registro na Justiça Eleitoral, havendo indícios, inclusive, de se tratar de algo sem consistência“. Nos casos em que ocorre a divulgação de pesquisa eleitoral fraudulenta, além da multa, o réu também pode responder criminalmente.

A juíza ressaltou que o risco de demora é evidente, pois a continuação da divulgação de uma pesquisa possivelmente irregular pode comprometer o processo eleitoral. Dessa forma, a juíza da Justiça Eleitoral determinou que os requerentes removam as publicações e que não façam novas publicações, sob pena de uma multa diária fixada em R$ 10 mil (dez mil reais), até o limite de R$ 100 mil.
Quem são os apoiadores e candidatos acusados?
Os apoiadores e candidatos acusados de divulgar uma pesquisa eleitoral sem registro incluem o pré-candidato a prefeito Audifax Barcelos (PP) e seus apoiadores, que contam com dois vereadores da Serra, uma pré-candidata a vereadora e um ex-vereador. Do lado do PL, os acusados são o pré-candidato a prefeito Igor Elson e um pré-candidato a vereador do mesmo partido.
