O prefeito da Serra, Sérgio Vidigal (PDT), enviou para a Câmara da Serra no dia 13 deste mês, o veto ao Projeto de Lei 19/2024, que institui o Programa Municipal de Internação Involuntária de usuários de drogas em situação de rua, alegando vício de iniciativa. No início do mês de maio, o projeto foi aprovado pelos vereadores durante sessão ordinária na Câmara Municipal da Serra.
Conforme já divulgado pelo Serra Noticiário, o projeto de autoria do vereador Darcy Junior (Republicanos) tem como objetivo uma solução para o crescente número de pessoas vivendo nas ruas da cidade, o que tem gerado um clamor dos serranos para que o poder público interfira e resolva o problema.

De acordo com o vereador, o acúmulo de pessoas vivendo na rua resulta em cenas como prática de sexo explícito, uso de drogas nos espaços públicos e pequenos delitos que são cometidos como forma de financiar o vício.
De acordo com o texto do Projeto 19/2024, “considera-se Internação Involuntária aquela que ocorre sem o consentimento do dependente, a pedido de pessoa da família, responsável legal ou autoridade competente”.

A matéria determina que a internação involuntária pode ser realizada após laudo feito por médico responsável, e perdurará apenas pelo tempo necessário à desintoxicação, no prazo máximo de 90 dias, tendo seu término determinado pelo médico responsável; a família ou o representante legal poderá, a qualquer tempo, requerer ao médico a interrupção do tratamento. Além disso, o texto prevê que a internação involuntária só será indicada quando os recursos extra-hospitalares se mostrarem ineficientes.
Veto 25/2024
O projeto foi votado e aprovado pelos vereadores em maio, desde então, aguardava a análise do Executivo municipal para se tornar ou não lei. A análise resultou no veto, que teve dois pontos como principais argumentos:
Abordagens humanitárias:
A prefeitura alegou, através de uma nota da Secretaria Municipal de Direitos Humanos, que “qualquer proposta que busque tratar a questão do uso abusivo de álcool ou drogas deve priorizar abordagens humanitárias, voluntárias e integradas […]” concluindo que o debate sobre políticas desse tipo deve respeitar os direitos humanos.
Vício de Iniciativa:
A prefeitura alegou ainda que esse tipo de proposta não pode partir do vereador, uma vez que cabe à prefeitura legislar sobre as atribuições das secretarias municipais.

Discordando dos argumentos da Prefeitura Municipal, o vereador Darcy Junior afirmou em conversa com a reportagem: “Os motivos apresentados não passam de desculpas para que a prefeitura siga sem agir, apenas assistindo o que está acontecendo. Defendem que a solução deve observar os direitos humanos, ignorando que essas pessoas estão literalmente morrendo nas ruas enquanto eles não fazem nada. Além disso, dizem não ser função do vereador legislar sobre essa questão, o que não é verdade, já que não estou criando uma nova atribuição para a Secretaria de Saúde, e sim exigindo que se cumpra o que a lei já estabelece como atribuição”.
