No dia 17 de setembro, a Polícia Civil do Espírito Santo (PCES), por meio do 12º Distrito Policial, concluiu um inquérito que resultou no indiciamento de sete pessoas, acusadas da prática dos crimes de calúnia, difamação e até ameaças contra o candidato adversário, Pablo Muribeca (Republicanos). Algumas dessas pessoas atuam ativamente na política da Serra e apoiam publicamente o candidato a prefeito, Weverson Meireles (PDT).
De acordo com o inquérito da Polícia Civil, os investigados foram acusados de espalhar informações falsas e xingamentos disseminados em grupos de mensagens e nas redes sociais contra o candidato a prefeito Pablo Muribeca. Entre as falsas informações, os envolvidos atribuíam falsamente crimes de rachid e violência sexual ao candidato. Segundo as investigações, Muribeca também foi vítima de ameaças. Ao todo sete pessoas foram identificadas e interrogadas pela Polícia Civil.

Abertura da investigação e interrogatórios
O inquérito foi instaurado a partir de uma notícia-crime apresentada por Pablo Muribeca à Polícia Civil, na qual ele informa estar sendo vítima de calúnia, injúria, difamação e ameaças. Segundo Muribeca na denúncia, os acusados estão ligados ao grupo político do PDT Serra e têm interesse em descobrir quem produz os conteúdos caluniosos e difamatórios.
Durante a fase de interrogatórios, Jean Cassiano, Priscila Pimentel, Alex Escanor, Diones Bravo e Eduardo Trarbach, todos acompanhados de seus advogados, optaram pelo direito de permanecer em silêncio. Entretando, Adane e Elaine decidiram responder das perguntas.

Durante seu interrogatório, Adane Danielle admitiu ter compartilhado conteúdo calunioso contra Muribeca após ser provocada por um assessor dele, mas não soube informar quem lhe enviou o conteúdo. Ela também assumiu que ocupa um cargo comissionado na Prefeitura da Serra, na gestão do atual prefeito Sérgio Vidigal (PDT), padrinho político do candidato Weverson Meireles.
Por outro lado, Elaine Montarroyos reconheceu ter gravado vídeos e áudios com o conteúdo calunioso contra Muribeca, afirmando que o fez por “razão política”, pois está trabalhando para tirar votos do candidato. Na denúncia, consta que ela também ocupa um cargo comissionado na prefeitura da Serra. Ela justificou sua ação ao afirmar que o conteúdo já estava sendo amplamente divulgado nas redes sociais e pensou que isso poderia ser um bom motivo para fazer Muribeca perder votos.
Conclusão do Inquérito policial
Em investigação conduzida pelo delegado Marcelo Nolasco, constatou que todos os acusados cometeram os crimes de calúnia e difamação contra o deputado estadual e candidato a prefeito da Serra, Pablo Muribeca.
De acordo com o delegado, o investigado Alex Escanor, além das acusações de calúnia e difamação, também foi identificado como autor de ameaças contra Muribeca em pelo menos duas ocasiões.
Segundo o delegado, as ações dos investigados demonstram que eles tinham o objetivo evidente de desmoralizar o candidato Pablo Muribeca e enfraquecer sua campanha eleitoral. Com base nas evidências, o caso foi encaminhado ao Ministério Público, que deverá analisar a possível aplicação dos crimes previstos na Lei de Crimes Eleitorais.
“Considerando restar evidenciado pela condição de deputado estadual e candidato ao cargo de prefeito municipal do noticiante (Muribeca), que as condutas dos investigados, demonstradas nos presentes autos, possuem evidente caráter de desmoralizar a este e enfraquecer a sua candidatura…”

Quanto aos crimes de calúnia e difamação, que são de natureza privada, o delegado informou que cabe à vítima, Muribeca, decidir se deseja formalizar uma queixa-crime em juízo por meio de advogado. Esse procedimento já foi comunicado ao candidato. Em relação às ameaças, Muribeca manifestou seu desejo de representar criminalmente contra o acusado. Agora, o caso seguirá para a Justiça.
A pena pelo crime de calúnia é de detenção de seis meses a dois anos, além de multa. No caso da difamação, a pena é de detenção de três meses a um ano, também com multa. Já para a ameaça, a pena é de detenção de um a seis meses, ou multa.

Dois dos indiciados também foram condenados por Fake News contra Muribeca
Conforme noticiado recentemente pela coluna Chico Prego do Serra Noticiário, os indiciados pelo Polícia Civil, Diones Bravo e Alex Escanor, recentemente foram condenados pela Justiça Eleitoral da Serra, em 30 mil reais cada, por divulgarem as mesmas informações falsas.
Apoiadores do candidato Weverson são condenados a R$ 30 mil cada por Fake News contra Muribeca
